Army judge uses, um, judgment.

Apparently the ergot-on-rye infection of judges actually, you know, judging things has spread to the United State military.
Damn them!

Damn those liberal, activist…uh…career military…uh…UCMJ-bound…oh, forget it.


Judge Halts England's Sentencing Hearing

FORT HOOD, Tex., May 4 -- A skeptical Army judge Wednesday expressed further doubts about Pfc. Lynndie R. England's guilt in the scandal at Iraq's Abu Ghraib prison -- and then recessed her court martial to consider whether her guilty plea should be thrown out.

Photographs of mistreatment of Iraqi prisoners by U.S. soldiers at Abu Ghraib were made public a year ago. They shocked the world and badly damaged the global image of the United States and its military. The Army responded by bringing criminal charges against nine junior enlisted soldiers. No officers at the prison, and none in the higher chain of command, have faced charges.

In fact, though, Judge Pohl has raised doubts all week about the validity of England's guilty plea. In military law, a judge cannot accept a plea of guilty unless he is convinced it is true. The judge's concern emerged again Thursday morning as a former Abu Ghraib guard, Pvt. Charles Graner, testified in the sentencing phase.

[Pvt. Charles ] Graner, who testified he was England's lover at the time, said he directed her to hold the leash and pose for the photo. England had told the judge earlier this week that she had no training as a prison guard when the Army stationed her at Abu Ghraib, and thus she deferred to Graner and other experienced guards.
Judge Pohl interrupted, noting that England could not be guilty if she felt at the time of the offense that her action was legitimate. "Witnesses are providing evidence that you are not guilty," he told England. "If you don't believe you are guilty, you can't
plead guilty."
Apparently evil (and possibly liberal) Judge Pohl ain’t with the program. Maybe he was (gasp! Sound of ominous music) a Clinton Nominee (double gasp! Sound of children crying! And although military judges don't work that way, when did a little thing like the truth ever stand between a wingnut and their Blame Clinton For Everything meme) or something equally prima facia traitorous.

Apparently he hasn’t read the new Orders from Headquarters: to wit, God tell’s Tom DeLay or Randall Terry or “Heart Breaker and Nine-Lives-Taker” Herr Doktor Senator Frist what He Wants, and then they tell the judges what they’re supposed to do. Very simple, really.

And woe betide the poor dumb fucker who does not bend a deep knee to this God-To-Demagogue network. They risk impeachment...or “worse”, for as chief G2D Divine Cisco Router Pat Roberson explained over the weekend, “activist judges” (as opposed to “pacifist judges” I suppose) are the greatest threat to American Civilization in 400 years. Worse than terrorists. Worse that Nazis. Worse that the Evil Empire (no, not Star Wars I, II & III.) And oh how I wish I were being hyperbolic...but noted venomous squirrely fuck and #1 guy on Jesus' buddy list, The Right Reverend Robertson, said exactly that on This Week last Sunday.

And BTW, did anyone hear a single, Moderate Republican denounce this batshit evil Leprechaun? Any mobs up in arms over in Chafee-ville? Anybody up on Mt. Olympia Snow loudly calling for the creepy Mini-Anti-Christ to be kicked out of the party – or at least off the Homecoming Committee – for going on national teevee and discharging such patently malevolent bile?

Sounds of crickets chirping. Of pins dropping. Of a lone fly peeing onto cotton batting in a locked linen closet. All of these are orders of magnitude louder that the outcry from a single prominent Moderate Republican. And why?

Because Moderate Republicans are cowards. Skulking little mole-rats living in fear that one day a camera’s going to back them into a corner and force them to take a stand For or Against the likes of Robertson and Falwell and Dobson. And then the Good Times would be over, wouldn’t they boys? If you’re a Republican these days, you damned well know you gotta suck the Beelzecock if you want to get re-elected. And for a shot at the Big Prize, you have to take Lucifer’s own gnarled assrocket right up your own, private Hershey Pennsylvania Avenue don’t you?

And after that, you can sandblast your flesh, take as many scalding showers and drink as many fifths of Jack as you’d like, but you’ll never get the death-reek off of you and you’ll never forget that you betrayed your country into the hands of monsters for a little glory and a toke off the Power Pipe.

Because we won’t let your forget ;-)

However Evil-and-possibly-Liberal-but-we-don’t-know-yet Judge Pohl apparently did not get the memo. Perhaps a war that the President lied us into is keeping him too busy to keep up with the interoffice mail? If so, perhaps I can be of some assistance my pointing out the Lewis Carroll already laid out the Exciting New Reality in “Alice in Wonderland”, which is a much better read than bureaucratic memoranda.

Does this sound like a House Majority Leader that anyone knows?

Driftglass, I enjoy a good ribbing at moderate Republicans' expense as much as anyone, but when I heard about the judge refusing to accept England's guilty plea I was horrified. Are you saying you agree with the judge's rationale, that because England hadn't received proper training that she couldn't have known that forcing prisoners into a naked pyramid and putting them on leashes was wrong?

Has it come to the point where "I was only following orders" is an acceptable defense?

I understand Drifty's take to be that enlisted personnel should not be the ones perp-walked in and out of military courtrooms to face prison sentences for iumplementing policies that arose straight from the E-ring of the Pentagon.

"I was just following orders" is a pretty weak defense, but there are 100,000+ GI's who won't have much else to say when the many, many crimes of Chimpy and Rummy come to light.

I don't imagine the Judge had much stomach for sending another ignorant hillbilly to prison while the architects of this debacle suck down cut-price Johnny Walker Blue from the PX and tsk-tsk-tsk at the poor judgment shown by the not-so-bright economic enlistee from West Virginia.

Everyone who was involved in this needs to do time, Nurenberg-style. But it appears this half-bright hillbilly (who should indeed eventually be dropped in a cell for many years) was set up to be the stooge for her higher-ups, and was reading her script badly enough that the judge smelled a rat.
And this is what I want a judge to do: to really sift through the available facts and call them like he see's them.

So if this idiot doesn't end up enjoying the view from a Leavenworth cellblock, it'll be a shame. But if she doesn't have company from way, way up the chain of command, it'd be a tragedy.

The judge short-circuited a "Breaker Morant" trial. Maybe we could see Rumsfeld on the stand, but he would probably lie his ass off like the character in the movie.
